Atomic will not be liable for any loss that you may incur as a result of someone else using your account, either with or without your knowledge.

3.2 Payment terms

If you choose a paid subscription plan, you agree to pay all fees associated with your selected plan. Payment must be made by the methods specified on our website. All payments are non-refundable except as expressly provided in these Terms.

3.4 Free trial

We may offer a free trial of our premium Services. At the end of the trial period, we will automatically charge the applicable subscription fee unless you cancel before the trial period ends.

Subscriptions will automatically renew at the end of each billing cycle unless canceled prior to renewal. Users can cancel subscriptions through their account settings. Refunds are not provided for partial billing periods or unused Services, except where required by law.

7.4 Cap on liability

In no event shall our total liability to you for all claims arising from or related to the Services exceed the amount paid by you, if any, for accessing the Services during the twelve (12) months preceding the event giving rise to the liability.

8.2 Termination by Atomic

Atomic may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

8.3 Effect of termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10.1 Governing law

These Terms shall be governed by the laws of United Kingdom, without regard to its conflict of law principles.

10.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

10.3 Entire agreement

These Terms constitute the entire agreement between you and Atomic regarding the Services and supersede all prior agreements and understandings.

10.4 Assignment

You may not assign or transfer these Terms without Atomic’s prior written consent. Atomic may assign these Terms without restriction.

10.5 Force majeure

Atomic shall not be liable for any failure to perform its obligations where such failure is a result of acts of nature, war, civil unrest, or other circumstances beyond its reasonable control.
